I wish to participate In the Harbor to the Bay AIDS Ride. I understand that in participating in this event, I will be using public streets and facilities where many hazards exist and I am aware of and appreciate the risks that may result. I am also aware that accidents may occur during this event and that I may be seriously injured or killed as a result. I am voluntarily participating in this event with knowledge of the dangers involved and I agree to accept all risks of injury or death.
In consideration for being permitted by Harbor to the Bay, Inc. to participate in this event, I agree to assume all risks, and to release and hold harmless, Harbor to the Bay Inc., its officer, board members, designated beneficiaries, sponsors, officials, participating clubs, communities, organizations, friends of the event and all the other government or public entities including, but not limited to the Department of Transportation and affiliated organizations (and all their respective directors, officers, agents, employees and members), who, through negligence, carelessness, or any other cause might be liable to me.
I intend by this Waiver and Release to release, in advance, and to waive my rights and to discharge all of the person and entities mentioned above, from all claims of damage for death, personal injury or property damage that I may have, of which may here after accrue to me, as a result of my participation in this event, even though that liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective property equipment owned, maintained or controlled by them or because of their possible liability without fault. I understand and agree that this Waiver and Release is binding on my heirs, assigns and legal representatives.
I am physically capable of completing this event. If I am aware of or under treatment for any physical infirmity, ailment or illness, my medical care provider knows of and has approved my participation in this event. If there are any specific medical conditions that the first aid/safety crew should be aware of, it is my responsibility to so notify the individual in charge of that crew prior to the start of the ride. I acknowledge that I, and alone, am solely responsibility for my personal health and safety, and the personal property I bring with me. I will read the event description and rules for participation in the event and I will abide by all rules and regulations established by the event organizers and personnel as well as the local vehicle code. I agree to wear a properly fitted and adjusted ASIM-, ANSI-, CPSC- or SNELL- certified helmet while riding. I further agree that my participation in the event is subject to the sole discretion of the organizers and medical staff of the event, and that my participation may be limited by medical or other safety related reasons.
I understand that I must be at least 18 years or older at the time of the event in order to participate. I understand that my name, photograph, voice, or likeness may be used by Harbor to the Bay Inc., and their sponsors, beneficiaries, licensees, affiliates and employees. I consent to and authorize, in advance, such use and waive my rights of privacy I have in connection therewith. For Riders: I understand it is my responsibility to raise at least the amount of my fundraising commitment before the start date of the event. I understand that all my donations processed by the Donation Office are non-refundable even if I don’t participate in the event. I also understand that I must provide proof of health Insurance coverage in order participate in the event.
For crew members: I understand that as a member of the Crew, I will be part of a service corps that is the backbone of the event. Crew teams are filled on a first come, first served basis and availability is limited. I understand that I must provide proof of health insurance in order to participate in the event. I also understand that crew members are not required to fundraise.
